Musk’s $97B OpenAI Bid Contingent on Non-Profit Status

Elon Musk’s pursuit of OpenAI has taken another turn. His lawyers have stated in a court filing that the $97.4 billion bid from a Musk-led consortium for OpenAI’s non-profit arm is contingent on the company remaining a non-profit. If OpenAI proceeds with its plans to transition to a for-profit structure, Musk will withdraw the offer. This move intensifies the ongoing legal battle between Musk and OpenAI regarding the company’s future direction.  

Musk has been actively opposing OpenAI’s move towards a for-profit model, arguing that it deviates from the company’s original mission. OpenAI, however, contends that this transition is necessary to secure funding and remain competitive in the rapidly evolving AI landscape. The court filing emphasizes that if OpenAI’s board chooses to maintain its non-profit status and abandon the for-profit conversion, Musk will retract his bid. 

Musk’s involvement with OpenAI dates back to its co-founding in 2015 alongside Sam Altman. He later departed in 2018 due to disagreements over the company’s strategic direction and funding. Currently, Musk leads his own AI startup, xAI, making him a direct competitor to OpenAI. The situation is further complicated by OpenAI CEO Sam Altman’s stance that the non-profit controlling the company is not for sale, dismissing Musk’s bid as “ridiculous.” OpenAI has also filed its own response, arguing that Musk’s bid contradicts.

The ongoing dispute has raised questions about the valuation of OpenAI’s non-profit arm, particularly in light of potential funding rounds and restructuring plans.

SoftBank is reportedly in discussions to lead a substantial funding round in OpenAI, which could significantly increase the value of the non-profit’s stake in the company.  Analysts have suggested that Musk’s bid, regardless of its ultimate success, could establish a high valuation benchmark for the non-profit, potentially complicating OpenAI’s transition to a for-profit entity.
